Making the Law of Inheritance Easier to Implement in the Current Times

Abstract

Allah Azzawajal guided this Ummah with best of the things that would benefit the Ummah in this world and in the hereafter, one such thing of great benefit is the ordainment of Inheritance to be willed and directed before the death of a person, so that the wealth that the deceased left behind would be distributed with justice and would reach all those who have a right on it. However such an important ordainment that preserves the wealth of the Muslim nation, establishes justice on the land, and resolves financial disputes among the family members, is mostly being ignored by the Muslims of current times. The purpose of this research is to study all the aspects of the law of Inheritance and gather information from the Ummah on the issues and difficulties that they face in implementing the laws of Inheritance and come with ways to make the laws of Inheritance easier to implement among the Muslim Ummah in the current times. Effort will be made in this research to collect data directly from the Muslim Ummah in the form of surveys, interviews and discussions. Thereby gathering, consolidating and classifying the data in to various groups and analyzing the data and come with results that will lead to effective solutions. One major issue as observed from the analysis of the gathered data that 75% of the Muslim Ummah, are unaware of the laws of Inheritance and its importance and consequences on the Ummah by not following these laws in our current times. 56% of the Muslim Ummah, are confident that it will be made easier to implement the laws of Inheritance if the Scholars are more readily available to review and resolve the issues related to inheritance. 83% of Muslim Ummah believes that an online system such as Mobile application or a website endorsed, certified and monitored by Muslim Scholars would be of utmost benefit to make the laws of Inheritance easier to implement in our current times. As an implication of this study a Software Platform named Islamic Online Inheritance System is introduced in this research to address the identified issues, and to come with a solution that will resolve the issues related to Inheritance and make the laws of Inheritance easier to implement in the current times.
